I believe the ban is in effect as of today. The problem is that anything that is sold for use by a child of 12 years age or less now needs to be certified regarding its lead content. None of the mini motorcycles or ATVs have been certified for lead content, irregardless of whether they are made in China, Japan, or Europe. The dealers cannot afford to have their inventory tested for lead content, and it will take some time for the manufacturers to comply with the testing, so for the next year or so you will not be able to purchase an ATV or motorcycle that is sold for children 12 years of age, or less. This doesn't mean that these products contain too much lead, but rather, that lead content testing has not been certified.
There have been some killer deals on mini motorcycles and ATVs prior to today because of this legislation. Just last Saturday I bought a KTM 85 SX dirt bike for my youngest son. Retail price was $5300, and the dealer sold it to me for $3412, because as of today he would not be allowed to sell it at all.
